Terms and Conditions

1. Definitions
In this Agreement, the following terms shall have the meanings set out below:
1.1 "Site" means the website at www.congestless.com, including all content, features, and services available through it.
1.2 "We" / "Us" / "Our" / "Congestless" refers to Congestless Limited, a company registered in England and Wales under company number 17120379 whose registered office is at Polhill Business Centre, London Road, Halstead, Sevenoaks, TN14 7AA.
1.3 "You" / "Your" / "User" refers to any person or business accessing or using the Site.
1.4 "Content" means all text, images, audio, video, software, and other materials available on or through the Site.
1.5 "Terms" means this Agreement.

2.1 By accessing or using the Site, You acknowledge that You have read, understood, and agree to be bound by these Terms. 5.2 You represent and warrant that You own or have the necessary rights to submit the material and that its publication will not infringe any third-party rights or applicable law.
5.3 We may remove or refuse to publish any user-submitted content at Our sole discretion.

6.2 Third-party services or content embedded or linked through the Site may be subject to separate terms and privacy practices.
7. Disclaimers and Limitation of Liability
7.1 The Site and Content are provided "as is" and "as available", without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, accuracy, or completeness.
7.2 We do not guarantee that the Site will be uninterrupted, error-free, or available at all times. We are not liable for any loss or damage arising from the Site's unavailability.
7.3 To the fullest extent permitted by law, We exclude liability for any loss or damage arising from or in connection with Your use of the Site or reliance on the Content, including direct, indirect, special, or consequential losses.
7.4 Our total liability to You, whether in contract, tort (including negligence), or otherwise, shall not exceed the total amount paid by You to Us in the 12 months preceding the event giving rise to the claim.
8. Indemnity
8.1 You agree to indemnify, defend, and hold harmless Congestless, including its employees, agents, and affiliates, from and against any claims, liabilities, losses, damages, or expenses (including reasonable legal fees) arising from: Your breach of these Terms; Your unlawful or negligent use of the Site; and Your submissions to the Site, including any content You submit that infringes third-party rights or applicable law.
9. Termination and Suspension
9.1 We may, without notice and at Our sole discretion, suspend, restrict, or withdraw Your access to the Site at any time and for any reason.
9.2 Termination does not affect accrued rights or liabilities. The following clauses will survive termination: Intellectual Property (Clause 4); Indemnity (Clause 8); Limitation of Liability (Clause 7); General Provisions (Clause 12); and Governing Law and Jurisdiction (Clause 13).
9.3 Upon termination or suspension, You agree to cease all use of the Site and any Content obtained from the Site.
10. Privacy
10.1 Our Privacy Policy, which explains how We collect and use personal data, forms part of these Terms. You can view the Privacy Policy here.
11. Variation
11.1 We may revise these Terms from time to time. Any revised Terms will take effect when posted on the Site. Your continued use of the Site following any such modifications constitutes Your acceptance of the updated Terms.
12. General Provisions
12.1 If any provision of these Terms is held to be invalid or unenforceable, that provision shall first be amended to the minimum extent necessary to make it valid and enforceable. If such amendment is not possible, the provision shall be severed from these Terms, and the remaining provisions will continue in full force and effect.
12.2 These Terms, together with any documents expressly referred to herein, constitute the entire agreement between You and Us regarding Your use of the Site. These Terms supersede all prior agreements, representations, and understandings, whether written or oral.
12.3 The failure or delay by Us to enforce any provision of these Terms does not constitute a waiver of that provision.
12.4 We may assign, transfer, or novate Our rights and obligations under these Terms. You may not assign Your rights without Our prior written consent.
13. Governing Law and Jurisdiction
13.1 These Terms are governed by and construed in accordance with the laws of England and Wales.
13.2 Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
